What is Stepparent Adoption in Alberta?
In Alberta, Stepparent Adoption is a wonderful process that allows a stepparent to legally adopt their partner’s child. This is possible if:
- The child’s legal parent has married or entered into an Adult Interdependent Relationship.
- The child is under the age of 18 (if they’re over 18, an Adult Adoption may be an option).
- The stepparent wants to legally adopt the child.
- The legal guardian agrees to the adoption.
- The adopting family lives within Alberta.

For legal reasons, stepparent adoption works best in cases where one biological parent is not actively involved in the child’s life. The law recognizes only two legal parents, and adoption can sometimes mean removing one biological parent from the birth certificate. This is a serious step, and we’ll help guide you through when it’s appropriate.
In many cases, the biological parent may not be involved, or may be willing to voluntarily relinquish their rights. Whether the biological parent is absent or unable to contribute, stepparent adoption can provide a legal path to formalize your family’s structure.
